MediScriptNow  Terms & Conditions

Welcome to MediScript Now. By accessing or purchasing a MediScript Now license, you agree to the following Terms & Conditions (“Terms”). Please read them carefully before proceeding.

1. Acceptance of Terms

By completing payment or using the MediScript Now application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the software.

2. Licensing and Usage

  • Each license grants one (1) active agent access to MediScript Now for personal or agency-related use.

  • Redistribution, resale, or unauthorized sharing of the software or its contents is strictly prohibited.

  • Login credentials and application access may not be transferred or sold to any other person or agency without written consent.

  • MediScript Now reserves the right to suspend or revoke licenses for non-compliance or misuse.

3. Compliance & Disclaimers

  • MediScript Now is a sales scripting tool designed to assist licensed insurance agents with CMS-compliant conversations and documentation.

  • MediScript Now and its developers are not affiliated with CMS, Medicare, or any government agency.

  • We do not guarantee enrollment outcomes, compliance approval, or legal protection against audits or complaints.

  • You, as the licensed agent, are solely responsible for conducting your business in accordance with CMS, HIPAA, and all applicable federal and state regulations.

4. Limitation of Liability

  • MediScript Now and its developers, affiliates, or partners are not liable for any CTMs (Complaints to Medicare), regulatory fines, or legal disputes resulting from an agent’s actions, sales conduct, or call performance.

  • We do not assume responsibility for misrepresentation, mis-selling, or misuse of the software by any user.

  • Under no circumstances shall MediScript Now be held liable for loss of income, commissions, contracts, or business opportunities arising from use or inability to use the software.

5. NDA & Confidentiality

  • All users are bound by the MediScript Now Non-Disclosure Agreement (NDA) signed prior to access.

  • Users agree to maintain strict confidentiality regarding any proprietary content, scripts, or training materials contained within the MediScript Now platform.

  • Copying, sharing, screenshotting, recording, or distributing the application or its data without written authorization is a direct violation of the NDA and may result in legal action.

6. Payment & Refund Policy

  • All payments for MediScript Now are final.

  • Refunds are not available after successful payment and activation of your license.

  • In rare cases of duplicate payments or technical billing errors, please contact support@mediscriptnow.com for review.

7. Updates & Modifications

  • MediScript Now reserves the right to update features, pricing, or Terms at any time without prior notice.

  • Continued use of the software after updates constitutes acceptance of the new Terms.

8. Termination

We reserve the right to terminate or suspend access to any user found violating these Terms, the NDA, or any applicable laws. Terminated users forfeit any remaining access time or payments made.

10. Legal Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any legal action or proceeding shall be filed in Pasco County, Florida.

  • Agent Information: Name, email, phone number, agency name, and Agent ID (provided during sign-up or NDA completion).

  • IP Address: Captured automatically for security and verification purposes.

  • Login & Usage Data: Stored locally or securely on our system to manage licenses and session tracking.

  • NDA Submissions: Collected to verify identity, enforce confidentiality, and maintain compliance records.

2. How We Use Your Information

We use your information to:

  • Verify and activate user licenses.

  • Maintain compliance documentation and NDA records.

  • Improve security and prevent unauthorized use.

  • Communicate important updates, maintenance notices, or account-related issues.

  • Enforce our Terms & Conditions and NDA Agreement.

We do not sell, rent, or trade your information to any third parties.

3. Data Security

MediScript Now uses secure servers and encryption protocols to protect your personal and professional data.
Access to all user information is restricted to authorized personnel only.
Although we follow industry best practices, no system is completely immune to security risks; by using the app, you acknowledge and accept this limited risk.

4. Cookies and Local Storage

We may use cookies or local storage to remember your login data and preferences. These are used solely to improve performance and convenience, not for tracking or advertising purposes.

5. Sharing of Information

We may share limited data only when legally required or to comply with government or regulatory requests (such as CMS audits or subpoenas).
We will never disclose your personal or professional data to competitors, marketers, or outside organizations.

6. NDA and Confidentiality Enforcement

By using MediScript Now, you acknowledge that NDA submissions—including your name, Agent ID, signature, and IP address—are stored securely and may be reviewed in the event of a violation or compliance dispute.
This data will only be used internally for legal or administrative review.

7. Data Retention

We retain NDA records, agent credentials, and license data for as long as necessary to maintain compliance and service continuity.
Users may request deletion of their data after license expiration by contacting support@mediscriptnow.com.

8. Children’s Privacy

MediScript Now is intended for professional use by licensed insurance agents aged 18 and older. We do not knowingly collect data from minors.

9. Updates to This Policy

We may update this Privacy Policy periodically to reflect system improvements, compliance requirements, or security upgrades. Updates will be posted here with a revised “Last Updated” date.
